Product-Specific Terms: Recruit

These Product-Specific Terms are incorporated into and form part of our Master Subscription Agreement (or, as and when applicable, any other agreement you have with us in respect of the Services) (the “Agreement”). These terms apply to you when you use or otherwise access Dovetail Recruit.

  1. Definitions. (a) “Dovetail Recruit” means, with respect to our Services, Dovetail's research participant recruiting feature, including any APIs; (b) “Research Participant” means any research participants identified, made available to, or selected by Customer through its use of Dovetail Recruit; (c) “you” or “your” refers to any Customer or Authorized User of the Services; and (d) “we” or “our” refers to Dovetail. Any other capitalized terms used but not defined below have the meanings given to those terms in the Agreement.

  2. Permitted Use. You will not, and shall not allow others to: (a) use or copy Dovetail Recruit other than for creating, listing, and launching research studies through your Workspace (“Permitted Use”); (b) distribute, lend, or make Dovetail Recruit available to any third party on a commercial basis (but Customer may create products and services which use or call Dovetail Recruit available on a commercial basis, as set out below); (c) adapt, reverse engineer, decompile, disassemble, or modify Dovetail Recruit, except to the extent that those actions cannot lawfully be restricted or are in furtherance of the Permitted Use; or (d) recruit Research Participants originally sourced through Dovetail Recruit for any research studies not listed on the Services, including for repeat and longitudinal studies.

  3. Research Compliance. You understand and agree that by using Dovetail Recruit to list and recruit for research studies, you are responsible for ensuring that those studies are conducted in accordance with this Agreement and all applicable laws, including without limitation data protection and privacy laws. Without limiting the generality of the foregoing, you will ensure that you have all necessary rights, licenses, and permissions to conduct any such research studies, including ensuring that Research Participants are provided with or directed to a privacy notice that: (i) explains how you will receive and use their data and (ii) otherwise meets the requirements of applicable law.
